Short version: Buy a license, use the app on your Mac. Don't redistribute or reverse engineer it. The app is provided as-is. Refunds are handled by Apple via the Mac App Store. That's it.
These Terms of Service ("Terms") govern your use of Whisper Plus ("the App"), a macOS application published by Alexandre Brotto / brotto.io ("we", "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not install or use the App.
Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to install and use the App on Macs you own or control, in accordance with the Mac App Store Usage Rules (Apple's standard EULA also applies). This license does not transfer ownership of the App or the underlying intellectual property.
If you choose to use the optional AI Companion feature, you must provide your own API key from a third-party provider (such as OpenAI or Anthropic). Your use of those services is governed by their respective terms. We are not party to your relationship with those providers and are not responsible for their availability, pricing, or output. Charges incurred from those providers are your responsibility.
We may release updates to the App. Updates may add, change, or remove features. Updates are distributed via the Mac App Store and follow Apple's standard update mechanism.
The App is sold as a one-time paid app on the Mac App Store. The displayed price applies. There is no subscription and no recurring charge. Refunds are handled exclusively by Apple under Apple's standard refund policy. To request a refund, visit reportaproblem.apple.com or contact Apple Support. We cannot issue refunds on Apple's behalf.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be error-free, that transcription will be accurate, or that the App will be compatible with every macOS version, Mac model, microphone, or third-party app.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR RECORDINGS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. Our total cumulative liability arising from or related to the App shall not exceed the amount you paid to acquire your license.
This license terminates automatically if you breach these Terms. Upon termination, you must stop using the App and delete all copies. Sections 3, 7, 8, 10, and 11 survive termination.
These Terms are governed by the laws of Brazil, without regard to its conflict-of-laws principles. The parties consent to the exclusive jurisdiction of the courts of Foz do Iguaçu, State of Paraná, Brazil, for any dispute arising out of or related to these Terms, except where local consumer protection law mandates a different forum.
We may update these Terms at any time. Updated Terms are effective when published at https://whisper.brotto.io/terms.html. Your continued use of the App after the update means you accept the revised Terms.
